§1 Scope
These General Terms and Conditions apply to all bookings of the holiday apartments “Auszeit im Schwarzwald” in Lahr and Schwanau.
By booking, the guest accepts these GTC.
§2 Booking and Conclusion of Contract
Booking is made online via the booking system or in writing.
Upon completion of the booking, the selected period is initially reserved for 48 hours.
The rental agreement is concluded once the agreed deposit has been received by the landlord on time.
When paying by PayPal or credit card, the rental agreement is concluded immediately upon successful payment.
After payment is received, the guest receives a booking confirmation.
If payment by bank transfer is not received within 48 hours, the landlord may cancel the reservation and rent out the period to someone else.
§3 Payment Terms (extended version)
The deposit amounts to 20% of the total price and must be paid within 48 hours of booking.
When paying by PayPal or credit card, payment is made immediately during the booking process.
The remaining balance must be paid no later than 30 days before arrival.
For short-notice bookings (less than 30 days before arrival), the full amount is due immediately.
If payment deadlines are not met, the landlord may withdraw from the contract and re-let the period.
Utility costs for electricity, water, heating and parking are included in the rental price unless otherwise agreed.
Bed linen and towelsBed linen and towels are provided by the landlord in both holiday apartments and are included in the rental price.Final cleaningHoliday apartment in Lahr: The cost of final cleaning is shown separately during the booking process and charged in addition to the rental price.Holiday apartment in Schwanau: The cost of final cleaning is included in the rental price.§4 Arrival and Departure
Check-in: from 5:00 PM
Check-out: Lahr → 10:00 AM Schwanau → 11:00 AM
Other times are possible by prior arrangement.
In the event of a delayed departure of more than 30 minutes, an additional night may be charged if this affects subsequent bookings.
If the guest fails to arrive on the arrival date and does not notify the landlord, the claim to payment of the agreed rental price remains in effect.
After 48 hours have elapsed, the landlord may make other arrangements for the accommodation.
§5 Withdrawal by the Guest (Cancellation)
The guest may withdraw from the contract at any time before the start of the rental period.
The withdrawal must be made in writing.
The following cancellation terms apply:
- up to 61 days before arrival: free of charge
- 60 to 31 days before arrival: 20% of the total price
- 30 to 15 days before arrival: 50% of the total price
- 14 to 8 days before arrival: 80% of the total price
- less than 8 days before arrival: 100% of the total price
Payments already made will be offset.
The guest reserves the right to prove that no damage or lesser damage occurred.
We recommend taking out travel cancellation insurance.
A substitute person may be provided, provided they accept the booking terms.
§6 Withdrawal by the Landlord
The landlord may withdraw from the contract if:
- agreed payments are not made on time
- force majeure or unforeseeable circumstances make renting impossible
- false information was provided during booking
In this case, payments already made will be refunded in full.
No further claims exist.
§7 Use of the Holiday Apartments
The holiday apartments may only be used by the number of persons stated at the time of booking.
Holiday Apartment in Schwanau (allergy-friendly)
The holiday apartment in Schwanau is designated as an allergy-friendly accommodation.
For this reason, pets are generally not permitted.
In individual cases, if there is a justified need (e.g. assistance dog), separate consultation may be required.
In this case, use may be declined for health reasons.
Smoking is not permitted in the apartment.
Holiday Apartment in Lahr
In the holiday apartment in Lahr, dogs up to a maximum shoulder height of 40 cm are permitted after prior registration.
The guest is liable for any damage or additional soiling caused by pets.
Smoking is not permitted in the apartment.
General Rules
- Parties and events are not permitted
- The house rules are part of the rental agreement
- The maximum number of persons must not be exceeded
§8 Guest Obligations
The guest undertakes to treat the holiday apartment and its inventory with care.
Damage or defects must be reported immediately.
In the event of culpable damage, the guest is liable within the framework of the statutory provisions.
On the day of departure:
- personal belongings must be removed
- rubbish must be disposed of properly
- dishes must be left clean
§9 Liability
The landlord is only liable within the framework of statutory provisions.
No liability is assumed for the guest’s personal belongings, except in cases of intentional or grossly negligent conduct by the landlord.
Use of any available games and sports equipment is at the guest’s own risk.
Arrival and departure are the guest’s own responsibility.
§10 Data Protection
Personal data is processed in accordance with the privacy policy on the website.
The data is used exclusively for processing the booking.
§11 Changes to the Amenities
Photos and descriptions serve to provide a realistic representation.
Minor changes to the amenities remain reserved, provided they are of equal value.
§12 Final Provisions
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
Insofar as legally permissible, the place of jurisdiction is the landlord’s place of residence.
§13 Right of Withdrawal
There is no right of withdrawal, as the services offered are accommodation services for a specific date.According to § 312g para. 2 no. 9 of the German Civil Code (BGB), there is no right of withdrawal for contracts for the provision of services related to leisure activities if the contract provides for a specific date or period for performance.German law applies.
